I'm just wondering about this. Here's the situation. I was selling a group of snakes awhile back and had a deal worked up with someone (not going to say names but he sells on this site). Anyways the buyer jacks around for a couple weeks and talks me down and we come to an aggreement. When the buyer shows up at my house he says "Sorry buddy backed out on me so I don't have the cash but I'll take them off your hands cause I know you have to get rid of them". Light goes off in my head 2500.00 in snakes for nothing hmmm. Well I asked him to give me what he did have in his pocket and we'd right up and contract for the difference and he could take them. He said no and got in his car and left. Well here's the deal I'm hearing now from people that he is out slandering my name saying I jacked him around and did this and that to him. I'm just wondering Am I in the wrong for not selling/giving him the snakes???

If I had a deal worked out and then the buyer wanted to change the terms I would say we stick to the deal you negotiated or forget it.

No money. No snakes. You may wish to politely explain to this individual that you are not a "drug dealer" and that you do not "front" snakes. Either he pays you all the money you are asking for (In cash!) or, stop wasting your time!

How could you be in the wrong? I wouldn't give $250.00 worth of credit to someone I didn't know, especially after you had that "deal" worked out. The only thing I would worry about, not talking about anyone in particular, because I don't know who you are speaking of, is now they know where you keep the snakes. But thats just my .02 worth. I don't trust many people anymore. After having a guy no show me, after I drove to a neighboring state to meet him at a show, trust is hard to come by.

Well I'm not worried about him knowing where my snakes are I've found a good home for them but this person has found out who has them now and is talking a bunch of crap about me... I'm not really worried about it other than he is a wholesaler and I'm not completely out of snakes and I don't want this person dragging my name through the mud. I do want to do business with people in the near future but I know this hobby and if your name is trash alot of people won't do business with you... One good thing is this said person has been banned from kingsnake so I guess someone is getting tired of his crap...

I'm not sure what I would do if I was selling snakes to a person picking them up, then the guy showed up and said he didn't have the money but would take the snakes anyway. Well...other than laugh at him I suppose. You definitely did no wrong and it really is a joke that the guy would be trying to slander you. By the way, if he really is committing slander, you always have ever right to legal pursuit. Sounds like he's just blowing steam though because he didn't get something for nothing. I do hope the home you found for those snakes is a good one. You had some amazing things.

Let me tell ya I'm very happy with the person that got the snakes. Me and him talk a couple times a week which makes me feel even better. I have spoke with an attorney about this and that option is on the back burner. We are building evidence at the moment but I really don't want to be an ass in this... Just want the name calling to stop... Maybe he'll see this thread...

I apologize in advance if this is a long post, but I plan to cover all aspects of this transaction in there entirety to the best of my ability. I would like to start by stating that I never slandered Mr. McCarthy and I apologize to him publicly if his "hearsay" was missconstrewed as such. Back in Nov. of 05 Mr. McCarthy(who was a good previous customer of mine) solicited me about purchasing his collection of venomous reptiles since he was moving to an apartment which would not allow venomous reptiles. I informed him I was interested but the collection was mostly low end and the only animal I was really interested in was an adult male D. polylepis to replace my breeder which had passed the year before. I informed him I would need to make a few phone calls to get orders on the rest of the animals to see if I would be able to sell them to cover costs. At that time we could not agree on a suitable price. Several weeks later (while several other large higher end groups of animals were on the market, several deals with which I had already committed to)Mr. McCarthy again contacted me and also listed the animals for a very high price on this site. I again made a call(I was still only interested in the one mamba for myself) and a friend of mine said he would be interested in covering the rest of the money(We offered Richard $2500) for the animals he wanted and I would sell the majority of the animals which were common and low end to cover cost. At this point I'd like to explain that I've been in this business for a while and know the value of the animals which Richard was offering, and 2/3 of my income at that point in time came from reptile sales so I was not about to pay retail prices for common animals which I planned to resell and none the less a large group of animals of which Richard originally solicited me to buy to "help him out" I informed Richard the deal would only work if my friend was able to come up with his portion of the money. Moving weekend for Richard came and I was in Dallas at the time. I planned to give Richard $500 in cash and a check for the rest as my friend was wiring his money to my account. On my way to Richards I was called by my friend and informed he had to back out at the last minute due to unforseen circumstances. Mr. McCarthy's phone was disconnected but I still drove 1.5 hrs out of my way to explain the situation and apologize for the inconvenience. Richard informed me the animals had to be gone that weekend as he was moving. So I offered to leave the $500 cash and sell the rest on commission for him and house them in the process for free.(I was not about to commit to money on very common animals which might have never sold for what he wanted)Richard wanted me to pay $500, take the common animals and leave the only animals of quality with him, which I said I would not due. The fact he wanted money but then wanted to keep the animals that he "had to get rid of right away rose my suspicions. I was all more weary when I saw the condition of the animals, which had been neglected during the last few months that he had been "moving" I guess. Also I wondered why he was "getting out of venomous" but planning to keep 1.1 P. australis in a 40 gallon aquarium. He also tried to sell me a bobcat which his let freely roam his home. I had no interest in any offers other than what we agreed on which was contingient on my friend pitching in. At this point I was still apologetic of the way the deal went but was in no way upset with Richard, in fact I told him I understood if he was upset with me, but I pointed out I had made it very clear from the beginning that I could only make the deal happen if my freind came through. Months later in Feb. 06 I saw Richard still trying to move the animals but offering trades for gilas, beadeds, or crocs. I told him I would be having pure Rio Fuerte beadeds shortly and offered a trade of one beaded and a pair of dwarf caimans (or their cash value) after several emails of him trying to hold out for more he agreed to the beaded and the cash value of the caimans. I told him this would work and we could do it as soon as the beadeds were ready to be delivered(after feeding several times etc) he said he had time. When the beaded was ready I contacted him, he said he was ready. I repeatedly tried to set up a time for pickup/delivery with no response, then after a week or two I recieved an email stating the animals were sold. I assumed this was his way of "getting me back" by leading me on then blowing me off. At this point I was upset, but didn't make any phone calls or send any emails to try to slander Richard. Customers who had been waiting to see if I got the animals called and I explained what happened, no slander involved. Last week the person who got the collection from Richard(who happens to be a long time customer of mine, and a very good one) called me about an animal I had and in conversation informed me of his own trade deal w/Richard, I congradulated him but also pointed out that I had supposedly had a "sealed" deal with Richard but he had backed out on and I was still not too happy about it(but life goes on) I have since seen the animals again at my customers and am happy to be able to say they are looking much better now. So the way I see it, he originally solicited me to "help him out" I set up a conditional purchase which unfortunately fell through at the last minute(but again, it was always conditional) I then offered a trade and cash offer for what he was looking for, we agreed and he completely blew me off and backed out. Maybe its even,maybe I should be mad, it doesn't really matter, but I never slandered Mr. McCarthy and I don't appreciate him trying to get things stirred up on this forum, this is not the place for such petty matters. In regards to him calling me a wholesaler, I am not, I have always been a retail business. Due to time constraints and other research projects I no longer sell venomous on the scale I once did(I also have strong personal feelings about the responsibility level of many new venomous keepers and feel that it is hard to sell venomous on the internet anymore with a clear conscience unless it's someone I know, so I choose for the most part not to sell on public sites but rather have customers call me) As to his remark about my relationship with kingsnake, it is well known I no longer have an account but it had nothing to do with any customer complaints or any problems with any of my animals or sales but rather a personell issue and that is all I feel is necessary to say about that. I again apologize for the long post but I really don't have time nowadays to participate in flame wars, thank you to those of you who contacted me to inform me of this thread so I could shed some light on it. Hopefully Richard does not waste his or my time any further with this frivolousness, neither one of us has lost anything and he gained several nice animals in his deal from what I hear.

Well I didn't say any names in the thread because I didn't want it to become a burn thread. Sorry to take up peoples time with this really just wanted to know if I was in the wrong for not giving 2500.00 in animals for 500.00 up front and not wanting to sign a contract. Take it how you want to but as far as I'm concerned if anyone wanted the animals money talks and bullshit walks. I'm dropping the venomous community cause there is too many shady people in it and I'm tired of f***ers acting like they are right cause they run a business. Then they want to go around talking shit cause they didn't get there way. Take it how you want my animals weren't neglected or malnurished your just saying that to make you look right. You also failed to mention that you were coming to the area to see family and would just come by for the animals. Also failed to mention that I called you several times before you got to the house. Also failed to mention that you didn't deal with me at the house you dealt with a buddy of mine... There is 2 sides to every story take it how you want to. Thanks for the great forum activity. I'm done like I said I never ment for this to turn into a flame contest...

All I can say about thread is that I have had several dealings with Maddreptiles over the past 4 years or so and ALL of them went smooth as can be! As matter of fact 2 of these deals did involve me giving them animals that he said he would pay me for after he raised some money. The deal we did a few months ago, Tim(owner) informed me that he would not have the full trade completed right away and I might have to wait quite a while for the animal I was looking for(A $2000 animal). Well after a couple of weeks of waiting he called up and we completed the deal as usual.This was much sooner than I expected and it was a welcome suprise.I was expecting and prepered to wait months for this to get done,Tim got it done much quicker than even talked about.Not to mention the animal is grade A++++ Just as he said!icant say anything about your dealings with MaddReptiles Richard.I can only say that they are one of only 3 people in the hot herp world I trust whole heartedly and I have delt with ALOT of people over the past 11 years.As far as those Nazis at KS are concerned.If they booted Tim from their site then they booted me too! That is a joke to ban someone for any reason other than fraud or clear and repeated violations of the TOS.(Which I never noticed from Madd) From someone who has been doing this a while and had countless good deals go down I will not be looking at or buying anything!! from the KS (nazi) calssifieds.....Trey
