Ricky, I'm not an attorney by any means, but if they do press the "flying over" thing you might want to have your attorney check into this:
Unless I'm mistaken Georgia's laws have an exception written into them for federally licensed cargo and freight companies, and also a 24 hour pass through exception, so that they don't impede on states rights. The constitution (I think) states that no state may pass a law that impedes on interstate commerce between two adjoining states. It is my understanding that this is so one state, Georgia, as an example cannot make any legal shipment from Florida to South Carolina, as examples, illegal. States rights is a complicated issue and best left to the licensed litigators and definitely do not consider this legal advice!!
I'd rather deal with an alligator than a litigator any day!!

Nope, if they're really saying this, they're either intensely stupid or hoping you are.
Even if the plane LANDS in an unfriendly state it doesn't matter because the airport and the airspace the plane flew through are federal jurisdiction. Stupidness like this is exactly why. Otherwise there would be lots of things that would be impossible to ship across the country.
If they're really making this argument, they're out of their minds.
