"BISMARK TRIBUNE (N Dakota) 31 December 04 Bill bites keepers of venomous snakes (Tom Rafferty)
A Bismarck legislator wants to make it illegal to possess venomous snakes, spiders and other creatures.
Rep. Margaret Sitte, R-Bismarck, said she is having a bill drafted in response to Bismarck police finding four deadly snakes in an apartment earlier this year.
Sitte said North Dakota law prohibits having skunks, raccoons and wolves, but not venomous animals. By putting the law in place, it would cover cities that don't have ordinances against venomous animals, as well as rural areas. "

Just another foot in the door. Our rights are flying away one step at a time. This just proves that we as Venomous keepers have no rights left. State governments could care less about why we keep Venomous Snakes and Lizards. If they would bother to teach ppl the truth of our hobby we mite keep more rights, but they only want to please the ppl that are against free keeping. I have come to see that if we want to keep our rights, we will have to fight like wild cats to do so. "I am setting here thinking of the absolute disregard of keepers rights".....Hope we keep our rights.....Be safe ya'll, Wally

Befor I knew about all this I dreamed about comming to the U.S. to live there. But after reading this and lots more things like this I`ll set my self some new horisonts. IT SUCKS BIG TIME !!!(I`m reffering to the prohibition of keeping hots.)

It sounds to me like they are trying to protect the priveledge (it's not a right) of the serious venomous keeper...
1. Describe and demonstrate to the Non-Traditional Livestock Council (NTL) the ability of handlers to maintain and control the animals safely. Relate details to the NTL of the experience of handlers with venomous species.
2. Provide details to the NTL including photographs of housing, feeding and handling techniques.
3. Maintain quality caging that is individually locked, with all cages containing venomous reptiles housed in a locked room.
4. Identify each individual animal with a method which readily distinguishes one animal from another, such as microchips. Photographs may be used for species that show a variance in color patterns.
5. Provide details to the NTL of a safety plan which takes into account how a potential emergency, including a bite, will be dealt with so as to avoid loss of life or serious injury. Inform local EMS, fire department and law enforcement of the presence of venomous reptiles in case of an emergency situation.
6. Contact a local hospital and show proof that they have been made aware of the venomous animals that will be in your care and that you have provided them with appropriate information that alerts them as to their role should a bite occur. Provide proof that appropriate antivenins and other emergency drugs are readily available should they be needed. Annually, provide proof that these drugs are being kept properly and up-to-date.
7. Provide a list of species being considered for accession and inform the office of the State Veterinarian and the local hospital mentioned in #6 of any new species that are acquired.
8. Importation- all venomous reptiles require a valid health certificate and an importation permit to enter North Dakota. The North Dakota State Veterinarian’s office must be called for a permit number that is to be written on the health certificate.
9. Penalties- due to the potentially dangerous situation that is created with the presence of venomous reptiles, any violation of any of these conditions may result in disciplinary action including, but not limited to:
a. confiscation and/or destroying all venomous reptiles in the collection
b. a fine of up to $5000.00 for each violation

That sounds realy good. I consider restrictions like that necesary but prohibiting hot keeping all together is unethical in my opinion. Happy herping(while you still can :P)

Restrictions are one thing, lets hope these restrictions don’t lead to bans. Remember, we can allow some restriction, but if they start adding more on after they pass these laws what will we do then? It only takes a few years to kill keeping rights, if they get one small wedge in the door, who's to say they want keep going. Just something to think about........Be safe ya'll, Wally

Why do people think its their duty to protect people from themselves? , We certainly are not an endangered specie. Laws that only protect idiots. Do we really need these folks in our gene pool using our air and other now limited natural resources? I guess thats the same folks that need a sticker on their lawn mower letting them know not to put their fingers under the deck while its running or have to have electrical wall outlet covers to keep them from shocking themselves or surgion general warnings on tobbacco products. Ha Ha
You do your thing and I'll do mine. I would hate to think someone could try and stop me aslong as its not hurting or endangering anyone other than myself .
I never would hurt a sole unless its to defend things I love, my own life, loved ones, and personal belongings that I haved worked hard and honestly to aquire. Just another way to die if some one were to try. always remember DO UN TO OTHERS AS YOU WOULD HAVE DONE TO YOURSELF. If I die doing so then thats my business and Id rather die than have someone tell me what I can and cant do when it comes to society protection laws that are made for our bennifit or maybe its just a money racket. A way to incriminate people. More money in your local goverments pocket so they can hire more enforcement officers to tell you how to live your life or else thanks to the PATRIOT ACT . No one can stop people who are willing to give their own lives to protect the things they love or just to make a statement. Look at whats happening in Iraq( suicide bombers) It can happen here just as easy as over there in Sandland. I thought this was a free country. The white american SUPER POWER and now there is not enough land and to many greedy people who only exploit our resources for their own financial gain without weighing out the consiquences. Its us the White Christian American who inslaved people, burned 100's of women on a steak as witches and we also iraticated the Native Americans from their land and homes, Destroy every resource we can make a buck off of and go and tell other countries how to live and force them to create a democracy, and destroy ancient cultures because a necked native in a tropical climate is not an civil way to live according to most missionaries who go to Central and South America to change cultures and then we say GOD BLESS AMERICA. Why should he?
Like the snakes I love & study, I am a harmless unique part of nature, untill you try to catch or kill me then I'll rattle my tail and show you my fangs loaded with venom, other wise I'll ly silent and let the world go by while minding my own.
Just an iritated rattlesnake reseracher that loves America just not the way society is headed.

All the old farms and land around here in the south are being taken over by devopment city slickers, and outsiders mainly form up north telling me the long term local yocal how to live.
If we all would take responsibility for our actions then these things would not be popping up all the time but in America every one has to point a finger or have a scapegoat excuse.

On principal, I'm opposed to all of this. I'm of the school that says you have ALL rights that are not denied to you by law. Unfortunately I guess we're outnumbered by those who feel that you have only those rights granted to you by law.
But back in the real world... Most of this plan sounds fairly sensible at first glance. It's mostly the microchip requirement I have a real problem with (combined with the fines). How do you get a snake from out of state? You have to arrange for the seller to implant the chip? Then if the snake comes in and dies? The seller can always blame it on inplanting the chip, which wasn't his idea. I know if I were a breeder/importer, there's no way I'd mess with selling to someone in this state...
Do need you need your own microchip reader (if these are $50 items then ignore this part)? If you buy a snake from someone, do have to find a vet willing to scan it for you or trust the seller and take a chance on $5000 fine?
If my saw-scale viper pops out 10 4" babies, you want me to stick a microchip in every one of them? Have you ever tried restraining a 4" snake? Am I in danger of getting $50,000 in fines if I'm inspected the day they drop?

Frist of all, oops, sorry about hitting post twice.
Second, before you say I'm being paranoid and the authorities will be reasonable about these situations, let me give you one of my favorite examples from federal law, which is enforced to the letter. Long about 1934 (one might have been 1968) they passed a laws with the following provisions (loosely summarized).
1) You now need a federal manufacturer's license to manufacture a pistol. They want to keep track of concealable weapons because they can be used in crimes, sounds reasonable.
2) You now need another license to manufacture a rifle with a barrel shorter than 16 inches on the grounds that people will cut down rifles to get around #1. Sounds reasonable.
Now, it's perfectly legal for me to go out and buy a pistol with say a 6 inch barrel. If I attach a shoulder stock to the pistol, thereby making it LESS concealable they WILL throw me in jail for violating #2.
If I owned a pistol with a 16 inch barrel (yes they exist), I could attach a shoulder stock, but if I remove it later, they WILL throw me in jail for violating #1, on the grounds that I have just "manufactured" a pistol without the proper license.
This was CLEARLY not the intent of this law, but you can call the BATF and ask, this is their stated policy...
